Official Contest Rules

Our State magazine invites photographers to enter the 2012 Fall Photo Contest by submitting images that capture the essence of North Carolina in the fall. Please read the following rules, terms, and conditions before submitting any photos.

Entry period: September 19 at noon – October 30 at 11:59 p.m.
Winners Announced: After November 2, 2012

Our State magazine’s 2012 Fall Photo Contest is open to amateur photographers only. Amateur photographers are defined as individuals who earn less than half of their income taking pictures. Entrants must be 18 years old as of September 19, 2012. Employees of Our State, immediate family of Our State employees, or professional photographers who earn more than half of their income taking pictures are not eligible to enter. Employees and immediate family members of any business providing prizes for this contest are also ineligible to enter.

Winner will be required to sign an affidavit affirming he/she entered under the rules noted above. Any determination that an entrant is in violation of the parameters of who may enter will be disqualified from judging.

Each photo must be submitted electronically, using the Official Submission Form at Entries may not be emailed directly to Our State, mailed via ground delivery to Our State, or submitted in any other format.

We are looking for striking digital images that capture North Carolina in the FALL SEASON. Images from summer, spring or winter will be rejected. Entrants may submit up to five photographs in the contest. All photographs must be submitted into one of five categories:
  • Landscapes & Places
  • People
  • Animals
  • Black & White
Images must have been taken since October 1, 2010 and within the state of North Carolina in order to be eligible.

Photographs must be in digital format. No print or film submissions will be accepted for entry into this contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable. All digital files must be submitted in jpg format only.

Photographs that have won other contests (online or print) or from which entrant has earned money are not eligible. Having received a designation of Grand, First, Second, or Third Place overall constitutes winning a contest.

Please do not overly manipulate or change by using photo editing software. Only minor burning, dodging, and/or color correction is acceptable, as is cropping. High dynamic range (HDR images) and stitched panoramas are NOT acceptable. For more information, read these comments on image manipulation. Images that do not meet these requirements may or may not be judged at the judging panel's sole discretion.

Approval of every image rests at the discretion of Our State magazine and the panel of judges. Photographs may not be approved if deemed inappropriate for any reason.

If you choose to include people in your submission, you are responsible for obtaining any necessary releases from the individuals depicted, and must be able to provide copies of those releases to Our State magazine upon request.

Entrants must not submit images that involve the willful harassment of people or animals, damage to the environment by the photographer, the taking of risks, or that infringe on the rights of any other photographer or person.

Photo descriptions must accompany all submissions, and should include the subject of the image, the location where the image was taken, approximate date the image was taken.

Judging will be conducted by a panel of professional photographers and Our State staff. All decisions of the judges will be final and binding.

All eligible photographs will be judged on originality, technical excellence, overall impact, and artistic merit.

Judges will select from a pool of up to 35 final images the First Place, Second Place, and Third Place winning images. They will also choose one winner from each category to be "Category Winners". A single image will not win more than one accolade in the contest.

Winning images will appear online at, but will NOT be published in the print edition of Our State magazine.

The winning images will be announced by November 2, 2012.

Prizes for this contest are coordinated by Bryson City / and include the following. Some restrictions will apply on prizes and the winner will be notified of those when package is awarded.

First Place: The First Place winner will receive a package including three-nights accommodations provided by Hidden Creek Cabin Rentals, a fully-guided raft trip for a family of four from Nantahala Outdoor Center, and breakfast for four at Fryemont Inn. Lodging stay value varies by season; approximately $900. Reservations for Hidden Creek Cabins are not available June 1 through November 1, weeks of Easter, Memorial Day, Thanksgiving, Christmas AND New Years NOT AVAILABLE. CONSECUTIVE NIGHTS STAYS ONLY. Nantahala Outdoor Center value varies by season; approximately $250. Valid anytime except Saturdays and Sundays in June, July, and August. Reservations required. Non-refundable/non-transferable. Expires 10-31-2013. Freymont Inn breakfast valued at $45. Please call for details.

Second Place: The Second Place winner will receive a package including two-nights accommodations provided by Lands Creek Log Cabins, a ½ day fly fishing tour for one from Fly Fishing the Smokies, and breakfast for four at the Fryemont Inn. Lands Creek Log Cabins value varies by season; approximately $500. Reservations not available June 1 through November 1, weeks of Easter, Memorial Day, Thanksgiving, Christmas AND New Years NOT AVAILABLE. CONSECUTIVE NIGHTS STAYS ONLY. NO PETS ALLOWED. Freymont Inn breakfast valued at $45. Please call for details.

Third Place: The Third place winner will receive a package including Great Smoky Mountains Railroad tickets for a family of four and breakfast for four at Fryemont Inn. Great Smoky Mountain Railroad value varies by season; approximately $300. Please call for details and blackout times. Freymont Inn breakfast valued at $45. Please call for details.

Category Winners: To be determined (approximate total prize value: $75)

The winner must comply with all instructions and restrictions listed here or in the prize notification communication, including the completion of an affidavit and liability/publicity release, and return them within ten (10) days of the date on the prize notification letter; otherwise prize will be forfeited and an alternate winner will be selected.

Liability for any applicable taxes associated with prizes will be the sole responsibility of the winner. Any required tax reporting forms will be furnished to the Internal Revenue Service. All expenses not specifically provided for by Our State in these rules are the sole responsibility of the winner. Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Our State reserves the right to withhold prizes until completed form W-9 is received.

The contest entrant retains rights to his/her photograph(s). By entering the contest, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Our State magazine and it’s Authorized Parties, to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in connection with the contest and promotion of the contest, in any media now or hereafter known, including, but not limited to: Inclusion in online photo galleries; downloadable wallpaper selections; display at a potential exhibition of winners; publication of a book featuring select entries in the contest; publication in Our State magazine or online highlighting entries or winners of the contest. Entrants consent to the Our State doing or omitting to do any act that would otherwise infringe the entrant’s “moral rights” in their entries. Display or publication of any entry on an Authorized Party’s website does not indicate the entrant will be selected as a winner. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made in connection with the contest, and pictures or likenesses of Contest entrants, or choose not to do so, at their sole discretion. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

Automated entry or voting of any kind is not allowed. Detection of said automated entry or voting will lead to submission and/or votes being voided.

Our State and the contest prize sponsor reserve the right to substitute any prize with another prize of equal or greater value.

Contest entrants agree to abide by the terms of these Official Rules and by the decisions of Our State, which are final on all matters pertaining to the contest.

The Contest and all of the related pages, contents and code are copyrighted to UPICKEM, Inc., and/or Our State. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.

Each winner, by acceptance of the prize, agrees to release Our State, and any parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.

No transfers, substitutions in prizes or cash will be allowed except by Our State or the contest prize sponsors, who may substitute a prize of equal or greater value. The Promoter will not replace any lost or stolen tickets, vouchers, certificates, or other prize items once they are in the winner's possession.

Entries that are lost, late, illegible or incomplete for any reason will not be eligible. Promoter reserves the right to modify or terminate this contest or disqualify any entry in the event of technical impairment by computer virus or otherwise. In the event of early termination, Promoter will randomly select winners from all eligible entries received at time of termination. UPICKEM and Our State are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.

If for any reason the contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Our State magazine that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Our State reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the contest. If Our State elects to cancel or terminate the Contest, Our State will not retain any rights in the submitted photographs.

Our State is not responsible for: (1) lost, late, misdirected, undeliverable or incomplete entries due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or entries; (2) technical failures of any kinds; (3) failures of any of the equipment or programming associated with or utilized in the giveaway; (4) unauthorized human and/or mechanical intervention in any part of the entry process or the giveaway; (5) technical or human error which may occur in the administration of the giveaway or the processing of entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt or use of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the giveaway. Promoter may prohibit an entrant from participating in the giveaway or winning a prize if, in Promoter's sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the giveaway by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Our State's representatives. If for any reason this giveaway is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Our State which corrupt or affect the administration, security, fairness, integrity or proper conduct of the giveaway, then Our State reserves the right at Promoter’s sole discretion to cancel, terminate, modify or suspend all or any part of the giveaway and to select potential winners from among all eligible entries received by Promoter up until the time of such cancellation, termination, modification or suspension, as applicable. CAUTION: Any attempt by an entrant to deliberately damage the website or undermine the legitimate operation of the giveaway may be in violation of criminal and civil laws and should such an attempt be made, sponsors reserve the right to seek civil and/or criminal prosecution and damages (including attorneys’ fees) from any such entrant to the fullest extent of the law.

All results posted are unofficial until winners respond to notification.

This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.

Our State reserves the right to change the rules at any time.
